Company Identity

WebhookTrade is a website operated by Explora Grow, Inc. (hereinafter, the "Company," "WebhookTrade," or "we"), a company registered in the United States. By using this website, you agree to the following terms and conditions, which constitute a binding agreement between you ("the user") and the Company.

Use of WebhookTrade: Disclaimer and Risks

No Financial Advice or Signal Generation

The WebhookTrade platform is not a financial advisor and does not provide investment advice of any kind. No information, configuration, or functionality of WebhookTrade should be construed as a financial recommendation, personalized investment advice, or an invitation to transact. Furthermore, WebhookTrade does not generate its own trading signals or market analysis; the platform is exclusively limited to routing (transmitting) the trading signals created and issued by the user (e.g., alerts configured by the user themselves in services like TradingView) to the brokerage account that the user has connected. In other words, any investment decision or operational signal comes from the user (or from third parties chosen by the user), never from WebhookTrade.

User Responsibility

The use of WebhookTrade requires the user to voluntarily connect their own third-party accounts to the platform, such as broker accounts (e.g., through API brokers like Capital.com or platforms like MetaTrader) or accounts on trading alert platforms (like TradingView). The user is solely responsible for establishing, managing, and maintaining these connections, ensuring they correctly configure the alerts or signals they wish to transmit through the platform. Any order or transaction executed via WebhookTrade will be considered initiated by the user's direct decision, even if the execution occurs automatically in response to a signal predefined by them. Consequently, all consequences of such operations are the exclusive responsibility of the user. This includes, without limitation, the financial results of the operations (whether profits or losses), any configuration or signal interpretation errors by the user, as well as compliance with the obligations and restrictions applicable to the third-party accounts the user connects (e.g., the broker's policies or limits of the signal's source platform).

Inherent Risks of Trading

Operating in financial markets, whether manually or automatically, involves significant risks. Asset prices can be volatile, and there is no guarantee of profit; in fact, it is possible to lose the entire invested capital. WebhookTrade does not reduce or eliminate the inherent risks of trading activity. On the contrary, by facilitating the rapid execution of automated signals, trades can be executed in seconds, meaning that losses can occur just as quickly if the market moves against the user's positions. The user is urged to trade only with funds they are willing to lose, having carefully assessed their risk tolerance, investment objectives, and personal financial situation before using the platform. It is the user's responsibility to stay informed about the markets in which they operate and, if they deem it necessary, to seek independent financial advice from qualified professionals before making investment decisions. In summary, the user voluntarily assumes the risks associated with trading when using WebhookTrade.

No Affiliation with Third-Party Platforms or Brokers

Although WebhookTrade is technically interoperable with third-party services (e.g., it can process alerts originating from TradingView or execute trades through brokers like Capital.com or those using MetaTrader), WebhookTrade is not affiliated with, sponsored by, or endorsed by any of these companies. Any mention of registered trademarks, trade names, or third-party platforms on WebhookTrade is made solely for descriptive purposes, to indicate the tool's technical compatibility, and does not imply the existence of a partnership, joint venture, sponsorship, or endorsement from such entities towards our service (or from WebhookTrade towards them). Likewise, interoperability with third-party platforms does not entail any liability on the part of those third parties for the operation or results of WebhookTrade, nor does it imply that such companies offer any guarantees regarding the operations carried out through our platform. WebhookTrade does not guarantee and is not responsible for the operation, availability, accuracy, or quality of integrated third-party services; the use of any external service through our platform is subject to the terms and conditions of those third parties, which the user must read and accept on their own.

Global Scope and Regulatory Compliance

WebhookTrade is a tool available to individual users globally, which means it may be accessible from different jurisdictions. However, WebhookTrade does not guarantee that the platform is appropriate or legal in all jurisdictions or that it complies with every specific local regulation. In particular, WebhookTrade is not registered or licensed as a financial service with any regulatory or governmental authority. The platform does not act as a registered broker or financial intermediary, nor as an investment advisor, nor does it offer trade execution services on behalf of others; therefore, it is not subject to financial regulatory supervision in any country. It also does not hold custody of user funds or securities at any time.

It is the user's responsibility to ensure that their use of WebhookTrade complies with the applicable laws and regulations in their country or region of residence. This includes (but is not limited to) regulations regarding securities markets, derivatives, currencies, fraud prevention, tax obligations, and any other legal requirement related to the automation of trading strategies. If any functionality of WebhookTrade is prohibited in the user's jurisdiction, they must refrain from using the service for such purposes. By using WebhookTrade, the user declares that their use of the platform does not violate any applicable law. WebhookTrade reserves the right to restrict, suspend, or terminate access for users in certain jurisdictions if it determines, at its sole discretion, that there is a risk of regulatory or legal non-compliance. In summary, the user uses WebhookTrade on the premise that they comply with the laws of their jurisdiction and exonerates WebhookTrade from any liability for its improper use in a prohibited legal context.

Responsible Use of the Tool

WebhookTrade is a technical automation tool, not a third-party managed investment service. The platform does not make investment decisions for the user or execute orders on its own initiative; it only performs the actions that the user has programmed through their signals or alerts. In other words, WebhookTrade does not act as an investment manager or as an agent operating on behalf of the user beyond the automated instructions configured by them. Likewise, WebhookTrade has no discretionary control over the user's funds or accounts, nor does it manage any capital: all transactions occur directly in the user's broker accounts under their own authorization.

The user is recommended to use the platform responsibly. This involves understanding how the automated signals they configure work and periodically monitoring their broker accounts to verify that the executed trades correspond to their instructions and expectations. WebhookTrade is intended for users who understand the risks of trading and the basic functioning of technological integrations; it is not a "guaranteed wealth" tool or a shortcut for those without experience in financial markets. The user must be fully aware that WebhookTrade only facilitates the technical execution of their own trading strategies. By using the platform, the user acknowledges and agrees that WebhookTrade does not provide advisory services, does not manage investments on behalf of others, and does not ensure positive results in the operations performed.

Limitation of Liability and Disclaimer of Warranties

WebhookTrade is provided "as is" and "as available," without warranties of any kind from the platform or its operators, whether express, implied, or statutory. To the extent permitted by law, we do not guarantee that the service will be free of errors, vulnerabilities, or interruptions, nor that it will fully meet the user's specific needs. It is also not guaranteed that the user's signals or instructions will be executed successfully, instantly, or without failure at all times. To maximize signal delivery reliability, we strongly recommend using the Webhook URL method, which has a typical error rate of less than 0.01%. In contrast, alternative methods such as send plain text/email can experience failure rates of up to 0.4% or more in atypical circumstances. The user assumes that delays, interruptions, or technical system errors may occur in the reception or execution of their orders through WebhookTrade. The user fully assumes these risks and agrees to use the platform with this understanding. Furthermore, WebhookTrade may perform scheduled maintenance that could temporarily affect the service's operation. Announcements regarding maintenance will be posted on the website's homepage. It is the user's responsibility to periodically check this page to stay informed, as signals may not be received and/or executed during maintenance periods. It is recommended to take the necessary measures by checking the homepage to see when the next maintenance date will be.

To the maximum extent permitted by applicable law, WebhookTrade (including its owners, developers, affiliates, and staff) will not be liable to the user or any third party for any damage, harm, or loss arising from the use of the platform or the inability to use it. This limitation of liability applies to both direct and indirect damages, and includes, but is not limited to: loss of capital or profits, lost business opportunities, business interruption, loss or corruption of data, costs of replacement for the use of alternative services, or any incidental, consequential, special, or punitive damages that may arise. Any liability for technical failures, errors in order execution, unwanted or delayed executions, or any system malfunction is also excluded, whether attributable to WebhookTrade, the user, integrated third parties, or force majeure events (such as connectivity issues, external service outages, etc.). The user understands and agrees that they use WebhookTrade at their own risk and that they are responsible for the decisions they make and their financial consequences. If the user does not agree with these disclaimer conditions, they must refrain from using the platform.

In the event that any jurisdiction does not allow the exclusion of certain warranties or the limitation of liability for certain types of damages, the foregoing provisions will apply to the maximum extent permitted by law. No part of these Terms and Conditions is intended to exclude a liability that cannot be excluded by law. In any circumstance, the total aggregate liability of WebhookTrade to a user (if any is determined) would be limited, at most, to the amount that said user has paid for the use of the platform (if applicable) or to the minimum required by applicable law.

Specifics

USAGE LIMIT: WebhookTrade establishes a limit of 1,000 signals per user per month. Exceeding this limit may result in a temporary restriction of the service.

API SECURITY: Each user is responsible for maintaining the confidentiality and security of their API provided by WebhookTrade. Any signal sent using your API will be considered authorized by you. WebhookTrade will not be responsible for unauthorized access or misuse of your API.

THIRD-PARTY LINKS: WebhookTrade may include links or integrations to third-party services or sites, but does not guarantee or take responsibility for the content or privacy practices of these external sites.

MODIFICATIONS: WebhookTrade reserves the right to modify these terms at any time without prior notice, and it is the user's responsibility to periodically review these terms.

CANCELLATION AND TERMINATION: WebhookTrade reserves the right to suspend or terminate your access to the service at any time, especially for breach of these terms or misuse of the service.

Subscription Plans and Trial Period

We offer a free five (5) day trial period. At the end of this period, if the user does not select one of the available plans on the https://webhooktrade.com/account/plan.php page, the system's scheduled processes will automatically deactivate the service at any designated time of the day, immediately blocking all signal sending until a valid plan is chosen.

Types of plans and billing

The price of each plan (hereinafter, "the Subscription") will be displayed before payment confirmation, and the automatic renewal will remain in effect until the user cancels or modifies their plan. All payments are processed through Stripe, in accordance with the applicable prices and taxes at the time of subscription.

Automatic renewal and cancellation

By subscribing to any of the plans, the user agrees to automatic renewal unless they cancel the Subscription before the end of the contracted period. The user can, at any time, cancel or manage their Subscription by accessing the same page https://webhooktrade.com/account/plan.php and selecting the "Manage Subscription" option.

Activation issues

In the event of an issue with the activation or renewal of the Subscription (e.g., system errors, payment gateway failures, etc.), the user must contact WebhookTrade support to resolve it. If the system cannot activate the Subscription for technical reasons attributable to WebhookTrade or its payment providers, the possibility of a period extension or a partial refund will be evaluated, as appropriate.

Refunds

Full refunds for voluntary cancellations are not provided. A partial refund will only be granted when the cancellation is due to a proven system failure that makes it impossible to use the platform properly. In such a case, the portion corresponding to the unused time will be refunded, deducting taxes and fees associated with the charge. Payments are not refunded for personal dissatisfaction, configuration errors, or lack of use by the user.

User responsibility

The user is responsible for ensuring they have a valid payment method and sufficient funds to cover the Subscription charges. Applicable fees and taxes may vary depending on the jurisdiction or payment currency and are borne by the user. The user acknowledges that by selecting a plan, they authorize automatic recurring charges.

Modifications to plans and prices

WebhookTrade reserves the right to modify the offer of plans and/or prices at any time, notifying the user with due advance through the provided contact means or through announcements on the website. The modifications will apply to the next billing period, in accordance with the automatic renewal conditions. If the user does not agree with the new conditions, they may cancel their Subscription before they take effect.

Partners (Referral) Program

WebhookTrade offers a Partners Program (hereinafter, "the Program") that allows selected users ("the Partner") to earn commissions by recommending the platform to new users ("the Referral"). Participation in the Program is subject to the acceptance of the following terms and constitutes a binding agreement between the Partner and WebhookTrade.

1. Eligibility and Acceptance

Participation in the Program is by invitation or application and is subject to the exclusive approval of WebhookTrade. We reserve the right to determine eligibility based on our own criteria, which we are not obligated to specify. By participating, the Partner agrees to all the terms described herein.

2. How the Program Works

3. Commissions and Payments

4. Discount Codes for Partners

5. Commission Priority Rule: Discount Code vs. Referral Code

This is a fundamental rule of the Program: If a user (regardless of whether they are a Referral or not) uses a discount code belonging to a Partner at the time of payment, the commission for that specific transaction will be assigned entirely to the Partner who owns the discount code. In this scenario, the original referring Partner (if any) will not receive a commission for that transaction, as the discount code takes priority for the attribution of the sale.

6. Rights of the Referred User and Unlinking

The Partner acknowledges and agrees that any Referred User has the right to request to be unlinked from their referral code at any time. If a user unlinks, the Partner will stop receiving commissions for that user's future payments and will lose access to their information in the dashboard.

7. Modification and Termination of the Program

WebhookTrade reserves the right to modify, suspend, or terminate the Program, as well as its terms and conditions, at any time and at its sole discretion. Any changes will be notified to Partners via their email or through an announcement on the website. Commissions legitimately earned before any changes will be honored.

Conclusion

This section is an integral part of the Terms and Conditions of WebhookTrade. By using our platform, the user acknowledges having read, understood, and fully accepted all the above points, releasing WebhookTrade from any liability not expressly assumed in these terms. Clarity in these aspects seeks to protect both the user and WebhookTrade, promoting an informed, safe, and responsible use of the trading automation tool.

This sharing is necessary for the Program's operation.
